Terms and Conditions
These are the Terms and Conditions on which Mini Creatives Club, operated by Victoria
Morales, ABN 96572434244, will provide services to you. By making a booking with Mini
Creatives Club, you are accepting these Terms and Conditions.
1. DEFINITIONS
1.1 Australian Consumer Law means Schedule 2 of the Competition and Consumer Act
2010 (Cth).
1.2 Confidential Information of a party means any information regarding that party’s
personal information or individual circumstances which is:
(a) by its nature confidential;
(b) designated as confidential by that party at the time of disclosure; or
(c) which the other party knows or ought to know is confidential.
Confidential information does not include information, documents, or materials that are
common property, are required to be disclosed by law, or are available in the public domain
otherwise than by a breach of these Terms and Conditions.
1.3 Fees means the amount payable for each class, event, or birthday party as determined
at the time of booking.
1.4 Services means the provision of classes, events, workshops, or birthday parties
involving creative, sensory, and messy play for babies, infants, and young children.
1.5 You means the person who has made the booking, the parent or guardian of a child
participating in the Services, or any other person attending a session, event, or party held by
Mini Creatives Club.
2. PROVISION OF SERVICES
2.1 Mini Creatives Club shall provide the Services on the booked dates and times.
2.2 You acknowledge that classes and events may include:
● taste-safe and food-based materials
● natural and sensory play materials
● paint, water, and messy play elements
● small pieces and loose parts
Wherever possible, Mini Creatives Club will use high-quality, child-safe materials.
2.3 You acknowledge that Services are often conducted:
● outdoors
● in natural environments
● at third-party or private venues (including farms, wellness spaces, and private
properties)
and may involve uneven surfaces, weather exposure, and interaction with natural elements.
3. FEES AND PAYMENTS
3.1 Fees are payable at the time of booking for all individual sessions and classes.
3.2 If you are booking multiple sessions, the Fees for all sessions must be paid at the time of
booking.
3.3 Birthday Parties:
(a) A 50% non-refundable deposit is required to confirm the booking.
(b) The remaining balance is due one (1) week prior to the event.
(c) If you cancel with more than 48 hours’ notice, a credit may be provided for future use.
(d) If you cancel within 48 hours of the event, no refund or credit will be provided due to
preparation and materials already arranged.
3.4 Any discount is offered in good faith and may be withdrawn at any time.
3.5 Fees may be updated from time to time and will apply to future bookings.
3.6 No refunds will be provided for change of mind.
4. CANCELLATION AND RESCHEDULING POLICY
4.1 If you or your child are unwell, you must not attend your booking.
4.2 Individual Sessions and Classes:
(a) More than 12 hours’ notice → full credit
(b) Less than 12 hours → no refund or credit
4.3 Rescheduling is subject to availability.
4.4 Late arrivals will not extend session time.
4.5 If Mini Creatives Club is unable to attend due to illness, weather, or unforeseen
circumstances, you will be offered a reschedule or credit.
4.6 Mini Creatives Club reserves the right to cancel sessions with low attendance. In this
case, a full credit will be provided.
4.7 Due to the outdoor nature of the Services, sessions may be rescheduled, relocated, or
cancelled due to weather conditions.
5. YOUR OBLIGATIONS
5.1 Participants should wear clothing suitable for messy play. Mini Creatives Club is not
responsible for damage to clothing or personal items.
5.2 You must follow all reasonable instructions provided for health and safety.
5.3 You must supervise your child at all times. Mini Creatives Club is not a childcare service
and does not provide supervision.
5.4 Children must wear appropriate clothing and footwear where required.
5.5 You must inform Mini Creatives Club of any allergies, medical conditions, or sensitivities
prior to participation.
5.6 You agree to respect the venue, environment, animals, and other participants at all
times.
6. LIMITATION OF LIABILITY
6.1 Mini Creatives Club takes no responsibility for any injury, loss, or damage occurring
during participation. Supervision of children remains the sole responsibility of the parent or
guardian.
6.2 While reasonable care is taken, Mini Creatives Club is not liable for:
● accidents or injuries
● allergic reactions
● incidents involving outdoor environments, animals, or natural elements
● incidents occurring at third-party venues
6.3 Mini Creatives Club does not provide an allergy-free environment. Participation is at your
own risk.
6.4 Nothing in these Terms excludes any rights you may have under Australian Consumer
Law.
7. PHOTOGRAPHY AND MARKETING
7.1 You may photograph your own child but must not photograph other children without
permission.
7.2 Mini Creatives Club may take photos or videos for marketing purposes, including use on
social media, website, and promotional materials.
7.3 If you do not consent, you must notify us prior to the session.
8. GENERAL
8.1 These Terms and Conditions may be updated from time to time and will apply to future
bookings.
8.2 These Terms and Conditions are governed by the laws of Queensland, Australia, and
the parties submit to the jurisdiction of its courts.
By making a booking with Mini Creatives Club, you agree to these Terms and
Conditions.
